There are many things to consider when going through a divorce, and one often overlooked aspect is the need to update your estate plan. Once a divorce is finalized, it’s crucial to undo the previous plan and create a new one.

The number of divorces are down over the last 10 years but it still they still impact a lot of families.

When my children graduated from high school, some of their friends’ parents decided it was time to move on and create a new life. Many had held on for their children’s sake and now wanted to find more happiness.

Real Life Story

A potential client called me today, anxious about an upcoming house purchase. Her closing was just weeks away, and she needed to sell her current house quickly. Despite being awarded the house in the divorce and having the legal right to sell it, she discovered that the property was still deeded to the trust she and her former husband had created years ago.

This realization meant she needed to have the house re-deeded before she could proceed with the sale. While this process is manageable, it requires her to contact her former spouse and involve a real estate lawyer, adding more stress to an already difficult situation.

How to Prevent More Stress

If she had consulted an estate planning lawyer right after the divorce, this issue could have been resolved without the pressure of an impending deadline.

If you have gone through a divorce, following up with an estate planning lawyer is essential as soon as your divorce decree is finalized. They can help you identify and address any loose ends, ensuring you avoid unnecessary stress in the future.
